This edition incorporates changes made by the 68th Regular Convention of the Synod, meeting in Milwaukee, Wisc., July 29–August 3, 2023, to the Bylaws of the Synod. Changes to the Bylaws include: • Very significant changes have finally been brought to the structure and function of the Concordia University System and to bylaws related to its colleges and universities (Bylaw subsections 3.6.6 and 3.10.6; [f]; 2.8.1–2.8.4.1; 2.9.1; 3.3.1.1.1 [c]; 3.3.1.2 [a]; 3.3.4.6; 3.3.4.10.1; 3.10.3.1–3; 3.12.3.5 [e–f]; 3.12.3.7 — Res. 7-04B and 7-05A). As to these changes, the rationales of the two related resolutions are fine explanations, not readily condensed to a sentence or two. • Requirements that agencies, auxiliaries, and recognized service organizations consult with district presidents in call processes have been distributed from to the appropriate sections of the Bylaws (; 2.5.1– 3; 6.1.2.1 [g–i]; 6.2.1 [d–e]; 6.2.2.2 — Res. 10-02). • Appointment and removal processes for reconcilers and hearing facilitators have been clarified and elaborated (; 1.10.12–1.10.12.3 — Res. 10- 01 [A–C]) and minor clarifications have been made to appeal panel processes ( [e]; 2.15.8 [e]; 2.17.8 [e] — Res. 10-01 [D]). • Candidate status renewal and requirements have been revised ( – Res. 10-06). • District and circuit representation now accounts explicitly for multi- congregation parishes involving congregations from different circuits or districts (; 4.2.2 [c]; 5.3.2 [d] — Res. 9-01 [C]). • Election procedures for circuit lay and pastoral delegates to the Synod convention have been revised ( — Res. 9-05A), as have those for election of circuit visitors ( [b] — Res. 9-02 [H]). • District election bylaws have been clarified ( — Res. 9-02 [G]). • Selection procedures for advisory delegates (–3.1.3.1 — Res. 9-02 [B]) and for educational institution advisory representatives ( [a] — Res. 9-02 [A]) have been revised and clarified. • Appointment procedures for chief executives of synodwide corporate entities have been revised ( — Res. 9-03), as have certain bylaws related to the Lutheran Church Extension Fund (; 3.6.4.2.2; 3.6.4.4.1 — Res. 9- 02 [D] and 9-10A). • Mission boards have received a new budget process function (; 3.8.3.1 — Res. 9-04). • Bylaws related to establishment of altar and pulpit fellowship have been clarified and simplified ( — Res. 5-06). • A bylaw related to eligibility for ordained colloquy has been clarified ( — Res. 6-05). • The requirement that seminaries deposit surplus institutional funds with the Synod has been removed ( [e][2] — Res. 9-02 [E]). • Procedures for nomination and election of the President and vice-presidents of the Synod have received minor, procedural revisions (, 4, 7 — Res. 9-02 [F, G]; 9-12) and regional Board of Directors and mission board members will be able to continue serving out their current terms if they move out of their regions of election ( [j] — Res. 9-07). The Synod, and every member of the Synod, accepts without reservation:
The Synod, under Scripture and the Lutheran Confessions, shall—
The Synod in convention is empowered to and has formed corporate entities which shall have legal powers:
Membership in the Synod is held and may be acquired by congregations and individuals, ministers of religion—ordained and ministers of religion— commissioned, of the Evangelical Lutheran Church who confess and accept the confessional basis of Article II. A. Voting Members All organized congregations that have joined the Synod hold voting membership.
Individual members of the Synod, who are non-voting except for those pastors exercising the vote of a member congregation or congregations, are the following:
Conditions for acquiring and holding membership in the Synod are the following:
All matters of doctrine and of conscience shall be decided only by the Word of God. All other matters shall be decided by a majority vote. In case of a tie vote the President may cast the deciding vote.
The synodical meetings are composed of regularly elected and delegated representatives and of certain individual persons, as specified in the Bylaws, to wit:
—A— The officers of the Synod are: 1. A President 2. Vice-presidents, in line of succession, as prescribed by the Bylaws 3. A Secretary 4. A Board of Directors 5. Other officers, as specified in the Bylaws —B— 1. The President, the vice-presidents, and the Secretary must be ministers of religion—ordained of The Lutheran Church—Missouri Synod and, like other officers and the members of the Board of Directors, members of voting congregations. 2. The time of service of all officers, boards, and commissions shall be fixed by the Bylaws of the Constitution of the Synod. 3. Any officer or any member of any board or commission ceases to be an officer of the Synod or a member of any board or commission as soon as he ceases to be a member of a congregation affiliated with the Synod.
The Secretary shall
The Synod in convention may adopt bylaws that are consistent with and do not contradict the Constitution of the Synod, which controls and supersedes such bylaws and all other rules and regulations of the Synod. Bylaws, which may be adopted, revised, or eliminated by a simple majority vote of a national convention, are binding regulations for the Synod and its conduct and governance.
